Florida Statutes 316.271 – Horns and Warning Devices – No horn or other warning device shall emit a loud or harsh sound or hiss in an inappropriate manner. No vehicle shall be equipped with a siren, whistle or bell, and no person shall operate a vehicle except as otherwise authorized by this section. Aside from “What`s your loudest horn?” the question we get asked most often is: Are train horns illegal? That`s certainly a good question. Just because you want to be heard on the street doesn`t mean you want to be ticketed or arrested. It doesn`t help that each state`s laws are different and can sometimes be very vague. You want to do the right thing and obey the law, but you also want to make sure people take note of it when you need it. So what do you do? We`ve seen a lot of people assume that air horns are completely illegal or that you can use them however you want! As experts in all things noisy, we decided it was our duty to set the record straight. Did you know that there is a precedent for horns that are protected by freedom of expression? It makes sense when you think about it.
We make horns to give people a voice on the street, and that voice should be protected. Sound far-fetched? The Supreme Court in Washington didn`t seem to believe it. As early as 2011, they decided in an En-banc statement that honking can constitute protected speech. According to the statement, examples could be: a driver of a ride-sharing vehicle honking to let a colleague know it`s time to leave, a driver responding enthusiastically to a sign saying you honk your horn if you support our troops,” wedding guests celebrating weddings by honking their horns, and a motorist, honking his horn in support of a person knocking on a street corner. 2. The driver of a motor vehicle shall, if reasonably necessary to ensure safe driving, sound an audible warning with the horn on the motor vehicle, but shall not use the horn for any other purpose while on a highway. Train horns are specially designed as a strong warning at railway crossings to avoid accidents. However, are they legal for other types of vehicles?
